Terms & Conditions
The following are the terms and conditions dealing with use of our website and services and by registering with us and/or by making a purchase you are agreeing to be bound by them. We may change these from time to time by updating this page.
1. Orders: Submitting an order through the website will be deemed as a contract to purchase the goods. Tyre Bay Direct is entitled to withdraw from any contract in a case of errors or inaccuracy regarding the goods or the order appearing on the site.
2. Availability: In the unlikely event that the goods are unavailable, Tyre Bay Direct will dispatch the order (or remainder of the order) within 10 days or offer a full refund for undelivered goods.
3. Pricing and Payment:
All prices are quoted in selected currency (£GBP €Euro or $USD) and are exclusive of VAT at the standard UK rate and are also exclusive of any other import duties, taxes, imports and/or levies payable in relation to the goods including state and federal taxes. All goods should be dispatched within 1 working days of acceptance of your order. However please allow 10 working days for delivery of your order within the UK. For shipping times to Europe and the US we will advise estimated delivery via e-mail. Carriage charges apply to all online orders outside the UK under a certain value. You will be charged delivery as per our delivery policy for any online orders, please refer to our delivery policy page for details. Shipping rates are subject to change without notice and should the shipping rate quoted differ to actual charges, customers will be informed prior to delivery and be given the option to change or cancel the order.
4. Payment: All prices are in pound sterling and subject to the delivery charge as noted above. Payment may be made by Visa, Switch, MasterCard, Solo and Delta. Additionally there is the option to send a cheque or pay on account if you are an existing account customer.
5. Returns Policy:
5.1 You can return goods received (see exceptions*) to Tyre Bay Direct within 14 days of dispatch with the completed goods return form available from our customer service department. *If you wish to return Tyre Racking you must notify Tyre Bay Direct within 3 days of delivery and return the racking within 7 days of delivery.
5.2 Returns received without a goods return form will not be accepted.
5.3 Goods returned where a delivery has been refused/not accepted will be accepted without the goods returns form.
5.4 Any goods believed to be faulty by you the customer, not fit for purpose or are not of satisfactory quality may be returned by you the customer or collected by Tyre Bay Direct at you the customers cost. This will be refunded/credited once goods have been assessed by Tyre Bay Direct and proven to be faulty, not fit for purpose or of an unsatisfactory quality. A replacement product will then be offered free of charge.
5.5 If goods are proven by Tyre Bay Direct or a manufacturer to be not faulty or unsatisfactory or are faulty due to negligence on your behalf then carriage/collection costs will not be refunded. A replacement will be offered at your cost.
5.6 On return of goods where you the customer have ordered in error/purchased on behalf of someone else in error or simply changed your mind, Tyre Bay Direct will not refund/credit any carriage incurred during the dispatch or return of the goods. Any refund/credit for goods will also be subject to a 20% handling and administration fee unless faulty.
5.7 Tyre Bay Direct will not be held responsible for items damaged or lost whilst being returned to the company unless a collection was arranged by Tyre Bay Direct.
5.8 This returns policy does not affect your statutory rights.
Please Note: If there are any issues with items or parts, eg. damaged, incorrect part etc, our customer services team will require photographic evidence before we can investigate further. This will help us to make any claims from suppliers, couriers etc and help us solve any issues.
7. Intellectual Property Rights
7.1 You acknowledge that Tyre Bay Direct own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site and the business of Tyre Bay Direct (including the structure design and layout of the web site) and assert all such rights worldwide.
7.2 You are entitled to use our web site in accordance with these terms and conditions. You must obtain Tyre Bay Direct prior written consent before you use the web site or any part of it in any other manner.
7.3 All persons, individual and corporate, are prohibited from providing hypertext or other links to the Tyre Bay Direct web site, from their own web site or from a third party’s web site, without our prior consent.
8.1 Tyre Bay Direct attempt to ensure that the information available on the web site at any one time is accurate. However we cannot guarantee that it will be fault free.
8.2 Tyre Bay Direct does not accept liability for any errors and admissions and reserves the right to change information, specification and description of listed goods, and products at any time.
8.3 Tyre Bay Direct does not make any warranty that the web site is free from infection by virus or anything else that has contaminating or destructive properties.
8.4 Tyre Bay Direct does not accept liability for any losses or claims arising from any inability to access the web site, or any failure to complete a transaction.
8.5 Tyre Bay Direct does not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of use of the web site for any products or services purchased from the web site.
8.6 Tyre Bay Direct will only be liable for direct loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the price of the product purchased in respect of any claim.
8.7 This liability section applies only to the extent permitted by law.
9.1 This Agreement does not confer or purport to confer on any third party any benefits or any right to enforce any term of this Agreement.
9.2 Tyre Bay Direct will not be liable for any delay in or failure to perform obligations if that delay or failure is caused by circumstances beyond their control.
9.3 All pictures on this website are for illustration purposes only and may vary slightly from the actual product supplied.
9.4 Time shall not be of the essence in the performance of this Agreement.
9.5 If for any reason any provision of these terms and conditions is unenforceable, the validity of the remaining provisions shall not be affected.
9.6 The terms and conditions and contracts between you and Tyre Bay Direct shall be governed by English & Welsh law and all disputes shall be submitted to the jurisdiction of the English & Welsh courts.
9.7 We understand and will exercise our statutory right to claim interest and compensation for debt recovery costs under late payment legislation if we are not paid according to agreed credit terms. The amount of compensation claimed will depend on the size of the debt as per details below.
Pay weekly / monthly prices are displayed as an estimate only and are subject to terms and conditions. Credit facilities available subject to status. Finance is only available for orders of at least £1,000 excluding VAT. Finance can only be taken out when paying full list price for items unless otherwise agreed.
11. Special Offers & Discount Codes
All special offers are subject to availability. All offers are subject to fair use policies and Tyre Bay Direct reserve the right to refuse any orders placed which they deem unacceptable. Cannot be used in conjunction with other offers unless otherwise stated. All special offers apply to mainland UK whereas some restrictions may apply outside mainland UK. Please contact us if you are unsure.
Deposits are returnable for a period of 28 days after the deposit is received. Should you change your mind during this time and cancel your order, we will return a maximum of 50% of your deposit to you, the customer.
Deposits will only be refunded in full, if Tyre Bay Direct does not keep to their side of the agreement or if you, the customer has agreed with Tyre Bay Direct beforehand.
Any claim that any Goods have been delivered damaged or do not materially comply with their description will be notified by you to us and (where appropriate, to the carrier) within 7 days of their delivery. Provided that you return such Goods to us in accordance with clause 5, we will at our sole discretion replace such Goods, issue you with a credit note for the price of such Goods or refund the price paid for such Goods.
Any claim that any Goods have not been delivered to you by us or our appointed carriers where we claim we have delivered the same to you, or left the Goods in a safe place or delivered the Goods to your neighbour and/or our appointed carriers have obtained a signature for the delivery of the Goods (from any of the above (where applicable), such claim must be notified by you to us within 7 days of their expected delivery. We shall then liaise with our carrier and/or our driver and we may require copies of two forms of personal identification documents from you (such as passport, driving licence, bank card etc.) or any third party. Once we have reviewed all documentary evidence and statements from the relevant drivers we shall then come back to you within a reasonable timescale of our decision (to replace such Goods, issue you with a credit note for the price of such Goods, refund the price paid for such Goods or to not provide any of the aforementioned) which shall be final and binding. The provisions of this clause set out your sole remedy in such circumstances.
